Terms of Purchase for Nexcore.com (USA)

Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Right of Withdrawal: The period during which the consumer can cancel the purchase.

  • Consumer: A natural person acting for personal, non-commercial purposes who enters into a distance contract with the seller.

  • Day: Calendar day.

  • Subscription Agreement: A distance contract covering a series of products and/or services for a specified period.

  • Durable Medium: Any means enabling the consumer or entrepreneur to store information personally addressed to them for future use.

  • Entrepreneur: Natural or legal person offering products and/or services via distance selling.

  • Distance Contract: A contract concluded as part of a distance selling system organized by the entrepreneur, where only distance communication is used until contract conclusion.

  • Distance Communication Technology: Methods of concluding contracts without the consumer and entrepreneur being physically present at the same time.

  • General Terms and Conditions: These applicable terms and conditions from the contractor.

Article 3 - Applicability

These terms apply to all offers and distance contracts between the consumer and Nexcore.

Before the distance contract is concluded, these terms will be made available to the consumer. If that is not reasonably possible, information on where to access these terms free of charge will be provided prior to the contract conclusion.

If product or service-specific terms apply, the terms most favorable to the consumer will prevail.

If any part of these terms is found invalid or unenforceable, the rest shall remain in effect. The invalid part will be replaced with a valid provision closest in meaning.

Article 4 - Offer

If offers are limited or conditional, this will be clearly stated.

Offers are non-binding and Nexcore reserves the right to modify them.

Descriptions of products and services aim to enable informed choices.

All images and specifications are indicative and not grounds for compensation or withdrawal.

Article 5 - Conclusion of Agreement

The contract is concluded when the consumer accepts the offer and fulfills the stated conditions.

For electronic contracts, confirmation of receipt will be provided promptly.

Nexcore may verify consumer payment ability and may refuse or conditionally accept orders.

Article 6 - Right of Withdrawal

Consumers have a 30-day right to withdraw after receiving the product, which must be unused and in original packaging.

Notice of withdrawal must be in writing within 30 days. Return shipping costs are borne by the consumer.

Article 7 - Prices

Prices are listed in USD and exclude customs or import duties, which the consumer must pay if applicable.

Prices may change without notice but do not affect placed orders.

Article 8 - Payment

Payment is due within 7 business days of order unless otherwise specified.

Non-payment may incur collection fees.

Article 9 - Complaints

Complaints must be submitted in writing within 7 days of receipt.

Nexcore will respond within 14 days with a solution or update.

Article 10 - Disputes

Agreements are governed by U.S. law. Disputes will be resolved in U.S. courts.
